Red Flag Rule Toolkit

On December 18, 2010 President Obama signed into law the Red Flag Program Clarification Act (S. 3987). The law redefines the term “creditor” under the Red Flag Rules and effectively exempts most health care providers including ambulance service providers from the requirements of the Rules.

Under the law, you need to adhere to the Red Flag Rules only if on a regular basis and in the ordinary course of business your operation:

  • obtains or uses consumer reports, directly or indirectly, in connection with a credit transaction;
  • furnishes information to consumer reporting agencies in connection with a credit transaction; or
  • advances funds to or on behalf of a person, based on an obligation of the person to repay the funds or repayable from specific property pledged by or on behalf of the person.
