Can You Fire for Hate Group Participation?

I am often asked by ambulance service managers if an employer can discipline or terminate an employee for their off-duty conduct. The answer is not an easy one and becomes more challenging when it involves an employee’s Constitutional Rights. In light of the activities in Charlottesville, Virginia this past weekend, the Society for Human Resource Management (SHRM) published a good article examining the issue. Without a doubt there will be increased legal activity related to this issue over the coming months and the we will keep our members updated on the law as it develops.
